Terms of Service for Companies

Please read these Terms and Conditions ("Terms") carefully before using TellClass.com ("the Service") for 1-to-1 English training with certified English-speaking tutors. These Terms form a legally binding agreement between you ("Client") and TellClass.com.

By using or accessing the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Service.

Section 1 - Description of the Service

Tell Class offers you, "the Client," a selection of certified ESL tutors for private, 1-to-1 online English lessons. Each lesson is 25 minutes long and aims to help your English students improve their English speaking skills.

Section 2 - Lesson Bookings

2.1 Scheduling and Availability

To book a lesson, students must request it 1 hour or more before the desired lesson time, but it is recommended to book 24 hours in advance via the “Find Available Tutors” page on TellClass.com platform. Lesson bookings depend on tutor availability. While every effort will be made to accommodate your preferred time, there may be instances when tutor schedules cannot meet your request.

2.2 Confirmation

Once a student requests a lesson, they will receive instant confirmation on their screen and via email.

Section 3 - Lesson Cancellations

If a student needs to cancel a lesson, they need to do so 4 or more hours before the scheduled lesson time to avoid penalties. If the student cancels less than 4 hours before the scheduled time, the paid lesson will be lost.

Section 4 - Pre-Payment

Lessons must be paid for in advance. If you are on a month-to-month plan, payments will be automatic, and your account will automatically be credited. If you pay annually, please pay the invoice before the end of your subscription to avoid delays in lessons.

Section 5 - Attendance and Punctuality

5.1 - Student Late for a Lesson

If a student is more than 10 minutes late, it will be considered a no-show. The tutor will not wait longer, and the lesson will not be refunded, as tutors are compensated for their scheduled time regardless of the student's arrival.

5.2 - Tutor No-Show

In the rare event that a tutor does not make it to a scheduled lesson due to unforeseen circumstances, the student will automatically be refunded for the missed lesson. This ensures that you only pay for lessons that are successfully conducted.

Section 6 - User Responsibilities

6.1 Providing Accurate Information

Please provide accurate and up-to-date information when registering for the Service. It is important to give correct information about students and your company.

6.2 Being Respectful and Polite

Students must behave kindly and respectfully during lessons. Bad language or inappropriate behaviour will not be tolerated and may result in them being banned, with zero or partial refund depending on the severity. Please note that all lessons are recorded for quality and security purposes.

6.3 Having the Necessary Technology

Students must ensure they have the necessary technology, such as a computer or smartphone, and a stable internet connection for lessons.

Section 7 - Privacy, Service Standards, and Refund Policy

Section 7.1 - Confidentiality

Tell Class values your privacy. We promise to keep all your information and data private. This means we will not share your company's information, student personal details, or any conversations from lessons with anyone outside of Tell Class. We will only share information if required by law or if necessary to provide the Service.

Section 7.2 - Student and Tutor Privacy and Communication Restrictions

To provide privacy and protection for all our company clients, Tell Class takes several measures to ensure that neither our platform nor our tutors will attempt to directly engage your employees or students. We do this by hiding the surnames of both students and tutors to maintain anonymity. Additionally, we do not allow any direct messaging outside of the classroom environment between students and tutors, nor is any personal contact information allowed to be shared within the classroom. Furthermore, all lessons are recorded for security and quality control purposes. These policies ensure that the learning experience of the students is both safe and secure, and that their privacy is maintained at all times.

Section 8 - Data Protection and Privacy

Tell Class is committed to protecting your personal data. We follow all relevant data protection laws to keep your information safe. We use secure systems to store your data and make sure that only authorized people can access it. For more details, please read our Privacy Policy.

Section 9 - Service Level Agreement (SLA)

Tell Class aims to provide excellent service. Here are the key points of our Service Level Agreement (SLA):

  • Response Times: We respond to your questions and support requests within 1 hour during business hours (Week days, 9-5pm UTC +2). Out of business hours might be a little slower.
  • Uptime Guarantee: We guarantee that our service will be available 99.9% of the time.
  • Support Availability: Our support team is available to help you 7 days a week.


Section 10 - Refund Policy

We want you to be happy with our service. Here is our refund policy:

  • First 14 Days Warranty: If you are completely dissatisfied within the first 14 days of signing up, we will refund all unused lessons or credit, less any discounts you received.
  • After 14 Days: After the first 14 days, we do not offer refunds. However, you can cancel your account before the end of the month to avoid the next debit order. 
  • Yearly Payments: If you are on a yearly payment plan, we will refund you for the unused months, less any discounts you received.
  • Transaction Fee: A processing fee will be deducted from all refunds, which covers the cost of handling the refund.


Section 11 - Unused Lessons Expire

We want to ensure that your employees make the most of the English lessons purchased to improve their language skills. Each allocated paid lesson must be used within 2 months from the date of purchase. If not used within this period, the lesson will expire, and no refunds will be provided for expired lessons. This policy encourages your employees to utilize their lessons effectively. However, any lessons purchased but not yet allocated to an employee will not expire and will remain available for future allocation to existing or new employee accounts.

Section 12 - Intellectual Property

The lessons and materials provided by TellClass.com are owned by Tell Class or their respective owners. You may use them for learning but cannot share or copy them without permission.

Section 13 - Pricing and Fee Changes

Tell Class reserves the right to change prices and fees for the Service at any time without prior notice. However, such changes will not affect the pricing of lessons already purchased and paid for in advance. We will make reasonable efforts to inform you of any changes to prices or fees through email or by posting updates on our website. By continuing to use the Service after any changes to prices or fees, you agree to the updated pricing terms.

Section 14 - Limitation of Liability

Tell Class and its affiliates are not responsible for any indirect or accidental damages that may occur while using the Service.

Section 15 - Modification and Termination

Tell Class may change the Service or these Terms at any time. Changes will be communicated to you. Tell Class can also end the Service or your access to it at any time.

Section 16 - Governing Law and Jurisdiction

These Terms are governed by the laws of South Africa. Any legal disputes will be handled in the courts of South Africa.

Section 17 - Language Schools

17.1 Protection of Language Schools' Interests

Tell Class acknowledges the importance of maintaining the relationship between language schools and their students. We assure that we will not directly solicit or attempt to engage students registered through a language school's company account to bypass the language school for a lower rate. Our platform is designed to support and enhance the services provided by language schools without undermining their business. 

Section 18 - Severability

If any part of these Terms is found to be invalid or unenforceable, the rest of the Terms will still apply.

Entire Agreement

These Terms constitute the entire agreement between you, "the Client," and Tell Class regarding the use of the Service. They replace any previous agreements or understandings.
